The claims process – what is involved in making a claim?
Most claims follow a similar legal procedure. The purpose of these procedures is to promote settlement of claims at an early stage wherever possible and avoid Court. Strict time limits apply to all claim types.

Frequently Asked Questions
In simple terms, it usually means you only pay our professional fees if your claim succeeds (for example, by settlement or judgment). “No Win, No Fee” does not automatically mean there are no other costs involved in a matter, because some expenses (called outlays or disbursements) can arise while the claim is running.
Your costs agreement should clearly explain what happens to professional fees and any outlays in both a successful and an unsuccessful outcome.
At Best Injury Lawyers, if a claim is not successful, we do not charge anything for professional costs, and we cover the costs of disbursements on behalf of our clients.
Timeframes vary depending on things like how long recovery takes, how quickly evidence (medical records, wage records and expert reports) can be obtained, and whether the other side disputes fault or liability under the insurance policy, or the value of the claim. Some claims resolve in months, while others can take longer, particularly if court proceedings are required.
A useful way to think about timing is that most matters move through stages: information gathering, notice and negotiations, and if needed, court steps.
Yes. Most compensation pathways have strict time limits, and some require early notice steps.
There is also often a broader “limitation period” that can apply to court proceedings. Because time limits differ depending on the type of claim and the circumstances, it’s important to get advice early so you can understand what dates apply to you and what steps (if any) must be taken first.
An uplift fee is an additional amount a firm may charge on top of its usual fees in certain speculative fee arrangements (it is not the same thing as “No Win, No Fee”). Best Injury Lawyers does not charge an uplift fee and our rates are set out in our costs agreement.
A 30% + GST cap means that, under the costs agreement, the firm’s professional fees are limited to no more than 30% of the compensation recovered, plus GST. By way of example only: if $100,000 is recovered, the professional fee component would be capped at $30,000 + GST (not including any separate outlays/disbursements, if applicable). The exact wording of the cap, what it applies to, and what is excluded will be set out in the costs agreement.
